Boobs on bikes tasteless but harmless, says judge NZ Herald August 20, 2008 ...Judge Mathers said it was not offensive per se for women to be topless and there was nothing to stop people riding vehicles down Queen St. "It may well be that the parade is tasteless but equally it may be that in a more mature society the vast majority might consider it harmless." Judge Mathers said it was not a court of morals and it was her job to stick to the law. The case boiled down to a new council bylaw and a council decision to turn down a permit for the parade on the grounds it was "offensive". Judge Mathers said she took into account the attitude of the police in not opposing the parade, the lack of any public disorder and the fact 80,000 to 100,000 had voted with their feet and watched the parade. "[That] leads me to the view that the bylaw is uncertain and or unreasonable in the way it refers to offensive," she said. The judge also questioned the lawfulness of the bylaw and whether it restricted rights under the Bill of Rights Act. ...Family First National director Bob McCoskrie, who was in court for the decision, said the Bill of Rights had just stomped all over the will and right of families. Capital Next for boobs on bikes Dominion Post Aug 20, 2008 A judge's refusal to stop today's Auckland Boobs on Bikes parade will probably lead to more topless parades with a Wellington version already planned, porn king Steve Crow says... Mr Crow confirmed plans for a topless bike parade through Wellington on November 7 in the lead-up to the capital's first Erotica Lifestyles Expo. Wellington City Council had not yet been asked for consent, but the parade would go ahead regardless and would feature a topless Prime Minister Helen Clark look-alike, Mr Crow said. Yes we are gutted! We are concerned at the continued decline of public standards. We are concerned that pornography is becoming more mainstream, and the effect that has on marriages, men, and our unacceptable rates of sexual violence. And we're concerned that the rights of groups like pornography businesses are deemed more important that the welfare and protection of families.

Council To Go to Court to Stop Boobs on Bikes Parade
TVNZ Aug 14, 2008 12:33 PM Auckland City councillors have voted to seek a High Court injunction preventing the controversial Boobs on Bikes Parade. The event involves topless women, porn stars and drag queens parading down Queen Street to promote an R18 expo. Councillor Cathy Casey says the organiser's claim the parade is about freedom of expression is nonsense. She says it is just free advertising for a porn show and the council finds the parade offensive. The organiser Steve Crow has said the parade will go ahead anyway. We will keep you informed of developments, but this is a great decision by the Auckland City Council, due in part to the huge numbers of people who emailed, wrote letters and phoned.

YES WE CAN STOP THE BOOBS ON BIKES PARADE
Very briefly, Councillor Cathy Casey is putting an Extraordinary Notice of Motion to the City Development Committee, to be held this Thursday, 14 August 2008
MOTION: That the City Development Committee take out a court injunction on behalf of Auckland City Council against Steve Crow to prevent him holding a parade down Queen Street to advertise his upcoming R-18 Erotica Expo.
REASON: Under Section 20.6.4 of the new Public Places Bylaw 2008 Auckland City Council has decided (via an urgent decision process) NOT to issue a permit to Steve Crow to hold a parade down Queen Street on 20 August to advertise his R-18 Erotica Expo. In the media Mr Crow has made it clear that he will hold the parade with OR WITHOUT a permit e.g. Sunday Herald, 10 August (attached). I believe that this flagrant disregard for the Council’s bylaw process should not be tolerated and that Steve Crow should be served an injunction by this council to prevent him holding a parade that the council has decided is offensive.

PLEASE TELL THE POLICE TO ACT TO STOP THE OFFENSIVE PORN PARADE Erotica Parade: Boobs on Bikes (20 August 2008)
Thanks to the voice of families, Auckland City Council have just passed a bylaw that enables them to decline a permit for a parade that is considered offensive. Council now has to have a special Council meeting to decline the permit. As the bylaw change was passed with a clear majority it is fairly certain Council will pass a resolution to decline the permit.
It will then be up to the Police to stop it and uphold the Council bylaws.
In the past the Police have made a decision it is not offensive and done nothing about it. One problem has been the objections come in after the event.
YOUR VOICE IS NEEDED
It would be great if there were over a couple of thousand letters so Police can not claim it is not offensive like they have done in the past. Numbers do help.
(If you actually live, work or regularly visit the Auckland CBD it would be good to make that point as well as they will probably be considered as having a greater interest than the rest of Auckland or NZ, although any one in NZ has a right to claim it is offensive to have this type of behavior in a public place let alone the main street of NZ's biggest city.)
TAKE ACTION: (it will take just a couple of minutes but will have great effect) Please write a brief, polite, and personal letter stating * that the parade is offensive * you will be offended by its presence in a major NZ city * the law (offensive behaviour under the Crimes Act) and the bylaw (Auckland City Council) should be enforced by the police.

The Auckland City Council heard our concerns and changed the Bylaw so they can now refuse Permits for offensive parades (like the Boobs on Bikes Parade).

Formal Police Complaint Made Against Boobs on Bikes Parade Family First Media Release 30 July 2008
Family First NZ has laid a formal complaint with the Police against the planned Boobs on Bikes Parade due to happen in Auckland’s Queen St in August.
“We are calling on the police to enforce the law and prevent offensive actions happening in a public place,” says Bob McCoskrie, National Director of Family First NZ. “This parade is an advertisement for the porn industry which is simply a business, with no regard for the welfare and protection of families who are exposed to offensive aspects of the parade. It is certainly not a charitable family-friendly event like the Santa Parade or a sports event or celebration." “This planned event will be in breach of Section 125 of the Crimes Act which clearly states that it is a crime to ‘wilfully (do) any indecent act in any place to which the public have or are permitted to have access, or within view of any such place. It will also now be in breach of a new bylaw just passed by the Auckland City Council (Bylaw 20.6.9 - Public Places 2008) banning public events likely to be offensive.”
“Most New Zealanders know and accept that it is indecent and inappropriate to be topless in a public place – which is why there is no acceptance of that behaviour in schools, workplaces, retail shops or public gatherings,” says Mr McCoskrie. “For those who stand for decency in public, and who seek to protect families and children, we argue strongly that a parade during lunchtime down a major street will cause widespread offence to families and children who may be there for completely unrelated matters, and as it is a highly public area, is therefore illegal and should be stopped by the police.”

'Boobs on Bikes' Parade
Auckland City Council officers have issued a permit that allows the passage of the Erotica parade down Queen St, at midday next Wednesday August 22nd.

Last year, the mayor Dick Hubbard said the parade was morally repugnant, that Council’s hands were tied because the parade didn’t need a permit, and the bylaw would be looked at. Yet not only is the Council unwilling to change the law, but it is even granting a permit to further validate this year’s parade.
It is also significant to note that the 'Boobs on Bikes' Parade has only occurred during the current term of Council and Mayor.
Section 125 of the Crimes Act clearly states that it is a crime to “wilfully (do) any indecent act in any place to which the public have or are permitted to have access, or within view of any such place.”
Despite what the Police say, the pornography industry is indecent and offensive to many people, and while private functions and Expos cater to a targeted audience, a parade during lunchtime down a major street will cause widespread offence.
The only way to affect a change would be an unprecedented avalanche of protest emails to the Mayor, Council members, and Chief Executive.
Points to mention in your email may include : - personal moral objection - objection to display of nudity in a public place - objection to promotion of pornography industry as a street parade - objectionable display to families and children - mention if you are an Auckland ratepayer, and therefore voter!
If you disapprove of Auckland City Council tacitly approving and thereby endorsing a commercial exercise that has topless, erotic dancers parading down Queen St.....
